Timothy McBride Quoted in "The Pink Sheet."
Senniger Powers Attorney Timothy McBride is quoted in the March 17, 2008, issue of "The Pink Sheet." McBride comments on the USPTO’s reexamination of Genentech’s so-called "Cabilly II" patent on a process to make monoclonal antibodies. This is the same patent that fueled the Supreme Court’s highly publicized MedImmune decision.
McBride notes that despite the USPTO’s rejection, the patent is "still enforceable as it stands now, but it’s under re-examination, and the office has issued an action saying the claims are not patentable." This means that even though the patent remains technically valid and enforceable, a court may temporarily stay any suits based on the patent until the reexamination process and any related appeals have ended.
