Kathleen Petrillo Quoted in BNA’s Patent, Trademark & Copyright Journal

Attorney Kathleen Petrillo is quoted in the August 15, 2008 issue of BNA’s Patent, Trademark & Copyright Journal. Ms. Petrillo offers an analysis of Proveris Scientific Corp. v. Innovasystems Inc. in the article "§271(e)(1) Safe Harbor Applies Only If Device Is Subject to FDA Approval." Ms. Petrillo notes that one impact of the decision is that "drug manufacturers who relied on the safe harbor provision to immunize their drug development process from infringement now have to reconsider their use of research tools and assess their freedom to operate in view of relevant research tool patents."
