Fleischut on Faculty for May 8 Patent Program

Senniger Powers attorney Paul Fleischut is on the faculty for the May 8, 2009 Intellectual Property Law Institute program presented by the Kansas Bar Association. His presentation focuses in one aspect on avoiding conflicts of interest which may arise in patent, trademark and copyright representation. Missouri, Kansas, and Model Rules 1.6, 1.7. 1.8, 1.9, and 1.10 all have implications for law firms and the in-house counsel who hire them in various situations when attorneys take on new representation, when firms merge, and when attorneys change firms. The presentation also explores application of certain of the rules specifically addressing integrity, including truthfulness in statements to others, misconduct, and reporting misconduct. In another aspect this presentation provides guidance on ethically contacting potential clients. Rules 7.1 - 7.5 govern advertising generally, as well as direct contact with prospective clients. Obligations specific to patent and trademark practitioners, including the Duty of Disclosure in patent applications, and inadvertant fraud in trademark applications, will also be addressed.
