Senniger Powers Wins Appeal for MEMC at the Federal Circuit - In Sumitomo Mitsubishi Silicon Corporation and SUMCO USA Corporation v. MEMC Electronic Materials, Inc., the United States Court of Appeals for the Federal Circuit affirmed summary judgment in favor of MEMC, confirming that MEMC had not violated the Sherman Act’s prohibition against attempted monopolization.

Partner Paul Fleischut Featured on CNN Radio - As attorney Paul Fleischut explains in an interview that aired on CNN Radio on July 29, 2008, the New York US District Court in Tiffany Inc. v. eBay, Inc. ruled on July 14 that even though 75% of all Tiffany-branded products sold on eBay are counterfeit, eBay's anti-counterfeiting safeguards satisfy its legal obligations. Under the law, Tiffany bears the ultimate burden of policing its trademark and protecting its brand.

Supreme Court Rules in Quanta Computer v. LG Electronics - In a unanimous decision written by Justice Clarence Thomas, the Supreme Court held that, as in its prior Univis decision, "method" patent rights may be exhausted under circumstances that exhaust corresponding "product" patent rights. PTO Considering Substantial Changes to Disclosure Requirements - Senniger Powers attorney Andrew Wegman explains the U.S. Patent Office has published proposed rules regarding the requirements for submission of information to the Patent Office that would significantly increase the burden on patent applicants in many common situations. The proposed rules here were approved by the U.S. Office of Management and Budget on December 10, 2007.

Proposed USPTO Claims and Continuation Rules Rejected" - A Virginia District Court rejected the USPTO's proposed rules on patent applications, stating that the rules are "in excess of statutory jurisdiction [and] authority." The proposed rules sought to limit the number of claims and number of "continuing applications" originating from a patent application.

U.S. Senate Judiciary Committee Approves Patent Law Reform Legislation - On January 14, 2008 the Committee issued a report urging the Senate to pass the Patent Reform Act of 2007 currently under consideration. The Act would fundamentally change the U.S. patent practice by converting it from a "first-to-invent" to a "first-to-file" system. The Act would also limit the manner in which compensatory damages may be calculated in infringement suits, and make procedural changes to the way patent lawsuits are pleaded and conducted. The bill will presumably be reconciled with a slightly different version which passed the House of Representatives last year by a close 220 to 175 margin. While the concept of reform has significant support in government and industry, the particular reforms under consideration have drawn substantial criticism. Debate in Congress is expected to be contentious, and passage is not a foregone conclusion.
